SURVEILLANCE- BREACH OF CONTRACT

Our client, a UK-based trades business reached out to us after suspecting one of their former employees of breaching their non-compete contract. The ex employee had worked in a senior position with access to the company's client list, and shortly after their departure, several valuable clients began discontinuing services without explanation. The business suspected the ex employee was stealing clients for a competing practice they had joined. 

 

The primary objective of this investigation was to conduct surveillance to gather evidence of the ex employee's activities, specifically to determine if they were breaching the contract as agreed with previous employer.

The evidence we collected allowed the client to successfully pursue legal action against the ex employee for breach of contract. The court ruled in favour of our client, awarding them damages to cover additional costs incurred and stopping further loss of clients and protection from future breaches. Furthermore, the evidence led to a renegotiation of the contract, with stricter terms and penalties for future non-compliance, protecting the client's interests in ongoing and future projects.

Following the successful legal outcome, we provided the client with recommendations for implementing stricter monitoring of employees and improving the services of conducting thorough background checks as well as  improving contract clauses to prevent similar issues in the future. We also offered ongoing surveillance services to ensure compliance with the newly negotiated contract terms, ensuring that the ex employee remained committed to their obligations.
